Terms and Conditions and Working Method

In these terms and conditions, the following definitions apply: Client/tenant; The other party to the Blije Bij themeakisten; participants in the services of the Blije Bij themakisten Contractor: the Blije Bij themakisten Participant: person participating in the Blije Bij themakisten on behalf of the client.

These terms and conditions apply to the rental of a Blije Bij themakisten (the contractor) made or entered into with third parties (the client), insofar as the parties have not expressly deviated from these terms and conditions in writing.

Participant obligations

• You must collect the theme box a few days before the party, as agreed. You must return it one or two days after the party, as agreed. Shipping is not possible! A collection and delivery service is available for a small fee, subject to agreement. Arrangements must be made via the contact form and email and must be complied with at all times.
• The boxes and all materials in the theme box are the property of Blije Bij themakisten and are for rental only.
• You must be able to provide proof of identity when collecting the theme box.
• Payment of the rental fee and deposit must be made immediately after the reservation is finalised. The amount must be paid within the payment term stated on the invoice.
• During collection, we will go through the script and explain the materials and contents of the theme box. Any questions can be answered at this time.
• After signing the rental agreement and paying the full rental price and deposit, you will receive the theme box.
• By completing the order form, you agree to the use of your personal data for the purpose of renting and invoicing the Blije Bij theme boxes. The data will not be used for any purpose other than to comply with accounting and other administrative obligations.
• We expect that the items will be treated with care, especially since some items are no longer available.
• Upon receipt of the theme box, you will receive an inventory list (which will be checked in full upon receipt of the box). This list includes the prices that may be charged in the event of damage or loss. The hirer is obliged and responsible for checking the Blije Bij theme box for completeness in advance. If anything is missing or not in order, this must be reported well in advance of the party. If this is only reported during or after the party, it can no longer be taken into account.
• The materials in the Blije Bij themakisten may only be used under parental supervision.
• The costumes may not be worn during activities where they could get wet or damaged, such as football or water fights.
• The fancy dress costumes must NOT be washed by the customer. De Blije Bij theme boxes will take care of this themselves.
• The renter must check that all items are back in the box(es). If anything is missing or damaged, please report this when returning the theme box.

• The invoice states the date and time by which you must return the box. If you are unable to do so on the agreed date/time, please call me as soon as possible so that we can find a solution together. This is because the box will probably be rented out again soon and maintenance must be carried out before it can be given out again. If this prevents another party from taking place, a fee of €40.00 will be charged. If you fail to comply with this obligation, De Blije Bij theme boxes is under no circumstances obliged to refund the deposit and may even retain it if the box is not returned at the agreed time and date. For each day that the theme box is returned late, an additional €10 will be deducted from the deposit, which may result in an additional charge. If, due to unforeseen circumstances, it is not possible to return the box on time, this must be communicated before the agreed time so that a solution can be found in consultation.

• If there is damage that falls outside the scope of normal use, an amount will be deducted from the deposit. If the deposit is insufficient, the difference must be paid. Of course, we keep in mind that these are children's parties and that ‘minor accidents’ can sometimes happen, causing items to be damaged or broken. This must explicitly concern normal use. All items will be checked when the theme box is collected and returned.

Payments

• Payment is made by bank transfer.
• Payment of the full rental and deposit costs must be made immediately after the reservation is finalised. The amount must be paid within the payment term stated on the invoice.
• The rental prices for the Blije Bij theme boxes vary. The theme boxes for children's parties are equipped for 5 children, including the birthday child. An additional €3.50 will be charged for each extra child. The theme boxes for children's parties can be expanded to accommodate up to 10 children, including the birthday child.
• De Blije bij theme boxes requires a deposit of €50. If there is no damage or missing materials, the deposit will be refunded within 7 days by bank transfer to the same account used for payment. If anything is damaged or missing, please report this when returning the theme box. Any damage/loss will be deducted from the deposit to cover the replacement value or repair costs.
• If there is damage that falls outside the scope of normal use, an amount will be deducted from the deposit. If the deposit is insufficient, the difference must be paid. Of course, we keep in mind that these are children's parties and that “minor accidents” can happen, causing items to be damaged or broken. This must explicitly be normal use. All items are checked when a theme box is collected and returned.
• If the date is available, you will receive a confirmation and an invoice by email. This will state the cost of the theme box, any extras that have been ordered, the deposit and the agreed times for collecting and returning the box.
• After signing the rental agreement and paying the full rental price and deposit, you will receive the theme box.
• The items in the box must be returned clean and undamaged. If the box is not returned clean, I will be forced to deduct €15 from the deposit to clean everything myself for the next renter.

• The invoice states the date and time by which you must return the box. If you are unable to do so on the agreed date/time, please call me as soon as possible so that we can find a solution together. This is because the box will probably be rented out again soon and maintenance must be carried out before it can be given out again.

• If another party cannot take place as a result, a compensation fee of €40.00 will be charged.

• De Blije Bij themakisten is entitled to deviate from these payment terms.

Ordering and collection

• After you have completed the order form, I will check whether the date is available. If you have any questions regarding the order form or if the date is no longer available, I will contact you first.
• If everything is in order, you will receive a confirmation and an invoice by email. This will state the cost of the themed box, any extras that have been ordered, the deposit and the agreed times for collecting and returning the box.
• Once payment of the invoice, including the deposit of €50, has been received, the order is final. 
• By signing the rental agreement, the tenant waives their right of withdrawal.
• If the theme box states that invitations are included, the invitations for the booked theme box will be sent to you as soon as possible. If the theme box is booked very shortly before the party, you may have to collect the invitations from me yourself.
• If you are unable to make it on the agreed date and/or time, please contact me by telephone as soon as possible!
• As De Blije Bij themakisten is a home-based business, I kindly request that you adhere to the agreed date and time so that I can maintain a separation between my professional and personal life.

Right of withdrawal

• Renting a themed box falls under the exceptions to the exclusion of the right of withdrawal, according to Article 230p_e. the consumer has no right of termination in the case of: e. a contract for the provision of services relating to the provision of accommodation, other than for residential purposes, the transport of goods, car rental services, catering, and services relating to leisure activities, if the contract provides for a specific time or period of performance.
• Upon signing the rental agreement, the tenant waives his right of withdrawal.

Returns.

• The invoice states the date and time by which you must return the box. If you are unable to do so on the agreed date/time, please call me as soon as possible so that we can find a solution together. This is because the box will probably be rented out again soon and maintenance must be carried out before it can be given out again. If another party cannot take place as a result, a fee of €40.00 will be charged. If you fail to comply with this obligation, De Blije Bij theme boxes is under no circumstances obliged to refund the deposit and may even withhold the deposit if the box is not returned at the agreed time and date. For each day that the theme box is returned late, an additional €10 will be deducted from the deposit, which may result in an additional charge. If, due to unforeseen circumstances, it is not possible to return the box on time, this must be communicated before the agreed time so that a solution can be found in consultation.
• Any clothing, tablecloths and placemats that can be washed must be returned dirty. De Blije Bij theme boxes wash these themselves.
• The items in the box must be returned clean and undamaged. If the box is not returned clean, I will be forced to deduct €15.00 from the deposit to clean everything myself for the next renter.
• Upon receipt of the theme box, you will receive an inventory list. This list shows the prices that may be charged in the event of damage or loss. Please check that all items are back in the box(es). If anything is missing or damaged, please report this when returning the theme box.
• After returning the box, I will check it at a later time. You cannot wait for this. If everything is returned on time, complete and in good condition, the deposit will be refunded within 7 days.
• If there is damage that falls outside normal use, an amount will be deducted from the deposit. If the deposit is insufficient, the difference must be paid. Of course, we keep in mind that these are children's parties and that minor accidents can happen, causing items to be damaged or broken. This must explicitly be normal use. All items are checked when a theme box is picked up and returned.

Cancel  

• Cancellation of a confirmed booking for a themed box can be made in writing by email. If desired, another date can be found free of charge.

Force majeure

• If, due to force majeure caused by external factors, whether foreseeable or unforeseeable, over which Blije Bij themakisten has no influence, Blije Bij themakisten is unable to fulfil its obligations, the obligations of Blije Bij themakisten will be suspended for a maximum of two months. If it takes longer than two months, both parties are entitled to terminate the agreement without any obligation to pay compensation in that case.

Liability

• The materials in the Blije Bij themakisten may only be used under parental supervision.
• The theme boxes may contain materials that could be harmful to the health of children under the age of 3.
• De Blije Bij themakisten is in no way liable for any form of injury or damage that may arise from the boxes and/or the use of the materials from the theme boxes. The hirer is at all times responsible for damage and/or injury sustained by guests during the party. De Blije Bij themakisten accepts no liability whatsoever for damage and/or injury caused by the use of the rented items.
• The lessor is liable/responsible for any loss, damage or theft of materials from the theme box. De Blije Bij themakisten is never liable/responsible for any loss, damage or theft of materials from the theme box.
• De Blije Bij themakisten is never liable for consequential damage.
• De Blije Bij themakisten cannot be held liable for damage caused by actions or omissions contrary to the instructions of De Blije Bij theme boxes or its employees, or errors attributable to the participant.
• Costs arising from damage and/or destruction caused deliberately by participants will be recovered from the perpetrator(s) themselves.
• De Blije Bij themaisten accepts no liability for damage for which compensation can be claimed under an insurance policy.

Other

• It is not permitted to make copies or duplicates of the script.
• Without prior permission from Blije Bij theme boxes, it is not permitted to reproduce information published or provided by Blije Bij theme boxes. In the event of trademark infringement, copyright infringement, breach of contract or failure to comply with certain obligations, legal action will be taken.

• The fancy dress clothes may NOT be washed by yourself. De Blije Bij themakisten will take care of this themselves.
• De Blije Bij themakisten is in no way liable for any form of injury or damage that may arise from the boxes and the use of the materials from the theme boxes. They may contain materials that could be harmful to the health of children under the age of 3.
• When you collect the box, we will go through the script and explain the materials and the contents of the theme box. Any questions can be answered at this point.
